Fair terms for serious builds. No fine print traps.

Every project is built for the business that commissioned it. We do not resell heavy WordPress themes or site builders that fall over on mobile data. The work is written around how your business actually runs, using Next.js, React, TypeScript, Tailwind CSS and a database chosen to fit the job.

These Terms of Service govern all proposals, statements of work (SOW), technical consultations, and software development engagements entered into between Devaltech and you (the “Client”).

Our engagements are structured into three clear starting tiers, available in Kenyan Shillings (KES) for local entities and US Dollars (USD) for international clients:

Features requested outside the agreed one-page project scope are billed transparently according to our published add-on rates:

• Extra standard page: KSh 3,000 ($30)
• CMS content management setup: From KSh 10,000 ($100)
• Payment integration (M-Pesa / Card / Escrow): From KSh 10,000 ($100)
• Authentication & user portal: From KSh 15,000 ($150)
• Custom administrative dashboard: From KSh 20,000 ($200)
• Full E-commerce storefront: From KSh 35,000 ($350)

Unless explicitly agreed otherwise in a signed Statement of Work, our standard payment structure is:

• 50% Initial Deposit: Due prior to project kickoff. This reserves your sprint calendar slot, initiates architectural design, and funds initial development infrastructure.
• 50% Final Payment: Due upon completion of development and client sign-off on the staging environment, immediately prior to final production domain routing and repository transfer.

For Scale tier projects exceeding KSh 150,000 ($1,500), payments may be structured into three or four milestone disbursements tied to verified deliverables (e.g. 40% kickoff, 30% alpha prototype, 30% launch).

Invoices are payable within 7 business days via direct bank transfer, RTGS/EFT, or official business M-Pesa channels. Work pauses if milestone invoices remain unpaid beyond 14 calendar days.

We pride ourselves on rapid execution (typical websites ship in 9 to 21 business days; custom web applications in 3 to 6 weeks). Meeting these timelines requires active collaboration.

The Client agrees to provide necessary text copy, high-resolution logos, brand assets, and feedback promptly. If a project stalls due to client inaction for more than 30 consecutive calendar days without prior notice, Devaltech reserves the right to archive the sprint and charge a rescheduling fee upon reactivation.

Every engagement includes dedicated revision rounds (1 for Starter, 2 for Growth, 3 for Scale). A revision round encompasses visual adjustments, spacing refinements, copy edits, color grading, and component tuning within the established design direction.

Fundamental scope changes-such as requesting an entirely different layout concept after prototype approval, adding new modules, or switching backend databases-are treated as add-on requests and quoted separately with client approval.

This is our non-negotiable standard: You own your code. 100%.

Upon receipt of full and final payment, all rights, title, and interest in the custom source code, frontend components, backend APIs, design systems, and database schemas created for your project transfer exclusively to you.

Devaltech retains the customary right to display non-confidential project screenshots, performance metrics, and public URLs in our portfolio, case study archives, and marketing materials. If your project is confidential, notify us prior to kickoff and we will execute a Mutual Non-Disclosure Agreement (NDA).

You are welcome to bring your own domain and hosting accounts, or let Devaltech provision and manage them on your behalf:

• Domain registration (.co.ke, .com, .org, .sc.ke): From KSh 1,000/year
• Standard production hosting & SSL: From KSh 6,000/year
• Managed enterprise cloud infrastructure: From KSh 12,000/year

Domains and hosting registered by Devaltech are always registered in the Client's name or transferred immediately upon request. We never hold domains hostage.

Every build shipped by Devaltech includes an automatic 30-day post-launch warranty starting on the day your site goes live on your primary domain.

During this window, Devaltech will immediately fix any broken links, form submission failures, browser rendering inconsistencies, or functionality bugs that depart from the agreed scope at zero additional cost.

Ongoing maintenance, periodic security audits, and content updates beyond the 30-day warranty are available through our monthly maintenance retainer (from KSh 3,000/month / $30/mo) or billed on demand.

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Kenya. Both parties agree that any dispute arising out of or in connection with this agreement shall first be addressed through direct, good-faith commercial negotiation.
